USC school district responds to rape suit An attorney representing Upper St. Clair school officials in a federal lawsuit over the alleged rapes of several girls at the high school in late 2007 and early 2008 has asked the court to dismiss some of the claims made by the family of one of the victims.The school district’s response, filed Sept. 2 in federal court, seeks to dismiss several, but not all, of the five counts alleged by the Bentz Law Firm, P.C. on behalf of former Upper St. Clair High School student “Jane Doe” and her parents. The female student, now age15, is attending another school due primarily to alleged rapes in a secluded stairwell of the high school. The girl, at the request of police, did go to St. Clair Hospital to undergo a rape kit in February. The male student accused by the girls is no longer in the district. He faces charges in juvenile court file by Upper St. Clair Police. His late August hearing was delayed until Oct. 6 at the request of his attorneys. Attorneys Anthony Sanchez and Christina Lane, and the law firm Andrews & Price filed the response on behalf of the school district. Sanchez is the appointed attorney from the district’s insurance carrier, the Pennsylvania School Boards Association (PSBA). Sanchez in his brief asserts the victim’s attorneys did not present enough detail in their complaint that proved wrong doing on behalf of the Upper St. Clair school officials named in the lawsuit. He said that there was no data presented to sustain the claim that the Pennsylvania Constitution was violated, and that school disticts are held exempt from punitive damages.Sanchez said the school officials named in the suit did not have personal involvement with the actions of the accused male student. “The only allegation directly involving Dr. Michael Ghilani is that he allegedly refused a request by defendant (Esther) Haugel (intervention specialist) to escort minor plaintiff to the bus. This allegation in and of itself does not rise to the level of personal involvement in the harassing conduct of Michael Roe.”The victim’s suit alleges Upper St. Clair administrators and teachers violated Pennsylvania and federal law when they declined to contact township police after their daughter began reporting violent assaults to school officials beginning in late 2007. Township police say they were not aware of the assaults until early February 2008. It was at this time the girl confided to her parents, who then called police. The alleged victims and suspect are all in the district’s special needs program. State and federal laws require school districts to involve law enforcement if they become aware of a credible safety risk involving students and threat of bodily injury. In addition, a memorandum of understanding between Upper St. Clair police and school officials dated Oct. 12, 1998, requires school leaders to contact police if there is an incident “involving an act of violence, or possession of a weapon by any person occurs on school property.” An internal township police memo in early March said two other girls reported groping and harassment to school officials by “the same male” as early as January 2008.Since the male involved is a juvenile, the entire record and disposition of his case has been sealed by the courts. He was detained at Shuman Juvenile Detention Center and then released under house arrest at his grandparents’ home in Upper St. Clair in late March. School officials named in the federal suit are Superintendent Dr. Pat O’Toole, Dr. Terrence Kushner, assistant superintendent, Dr. Michael Ghilani, high school principal, Dr. Sharon Suritsky, supervisor of special education, Jace Palmer, assistant principal, Lou Angelo, assistant principal, Esther Haguel, intervention specialist and Jennifer Wagner, teacher.“We contend their actions were deliberate and indifferent,” said attorney David Barton, representing the victim’s family. “Under the color of the law, you are liable if your actions are less than intentional, but more than an accident. What you are seeing is a tactical game. They are attempting to winnow down our claims in an attempt to remove all of them. We will file an answer to their motion to dismiss.” In civil suits, if one claim is found to be valid, the case is settled in favor of the plaintiffs.Since Feb. 4, sources indicate there might be up to eight girls who told police they were either raped or assaulted by a 14-year-old male both on and off school property.The 14-year-old male was first charged Feb. 7 by Upper St. Clair Township police with five counts of rape involving two girls. On Feb. 12, additional charges involving two more girls were filed by the police. Those charges included a single charge of rape, terroristic threats, aggravated assault and indecent assault on one victim and one count of aggravated indecent assault, two counts of simple assault and three counts of terroristic threats on a second.Unknown charges were filed allegedly involving two additional girls in early March.
